Probate Administration

Probate is the legal process of settling the estate of someone who has died (decedent). In New York, the probate process takes place in the Surrogate’s Court. It can be very difficult to navigate the probate process while you are also grieving. If you are facing the task of administering the estate of a loved one, please accept our condolences.

At The Law Offices of Farrukh Nuridinov, we help families manage the probate process so that they can settle their loved one’s estate fairly and properly and move forward with their lives. We work with executors and administrators who are in charge of administering the estate, as well as other family members or beneficiaries who have an interest in the estate.

Experienced New York Probate Administration Attorney

Probate begins with filing a petition for probate in the Surrogate’s Court for the New York county where the decedent last lived. If there is a valid will, the court will likely appoint the person named as executor in the will to administer the estate. If there is no will, the court will appoint someone (usually a close family member) as administrator. Administrators and executors are also called “personal representatives” of the estate.

Most personal representatives of an estate have never served in that role before and may need help fulfilling their duties. An experienced probate attorney can guide the personal representative through the probate process, including:

  • Opening a probate estate
  • Having the last will and testament (if any) verified by the court
  • Gathering and inventorying estate assets
  • Notifying heirs and creditors of the decedent’s estate
  • Preparing, filing, and paying income tax and other taxes of the estate
  • Paying all legitimate debts of the estate according to the priority established by law
  • Distributing remaining estate assets according to the decedent’s will, or according to New York state law if there was no valid will
  • Closing the estate

Attorney Farrukh Nuridinov guides clients through this process with care and compassion, ensuring that all documents are accurate and complete and all deadlines met. Most probate estates in New York are relatively straightforward, but occasionally a dispute arises between heirs, between a creditor and the estate, or between an interested party and the personal representative. Farrukh Nuridinov is an experienced courtroom attorney and is well-equipped to represent personal representatives, heirs, beneficiaries, creditors and others in probate litigation.
